1. General

These Terms and Conditions govern all purchases and use of our website thefrmed.com.au (“the Site”). By accessing or purchasing from this Site, you agree to be bound by these Terms.

2. Products & Pricing

All artworks, prints, and framing options are subject to availability. Prices are listed in Australian Dollars (AUD) and may change without notice. We make every effort to display products accurately, but slight variations in colour or finish may occur due to screen settings or handmade framing processes.

3. Payments

Payments are securely processed via Stripe or direct bank deposit (as arranged). Orders are confirmed once payment has been received in full. We do not store or have access to full payment card details. Some payment methods may require verification before shipping. By completing a purchase, you confirm that you are authorised to use the chosen payment method.

4. Shipping & Delivery

We ship both domestically and internationally using trusted carriers such as DHL, UPS, or Pack & Send. Estimated delivery times are provided as a guide only. We are not responsible for delays caused by carriers, customs, or other circumstances beyond our control.

International Orders:

• All customs duties, import taxes, and brokerage fees are the responsibility of the buyer.

• Once an order has been shipped, thefrmed. cannot control customs processing times or any additional charges that may apply in your country.

Non-Payment of Duties:

If you (the buyer) choose not to pay the duties, taxes, or import fees required by your country, the shipment may be returned to us by the carrier. In this event, thefrmed. reserves the right to charge the buyer for:

• All shipping costs incurred, including:

• The original shipping cost to send the artwork to you

• All return shipping charges imposed by the carrier

• Any customs, brokerage, storage, or border fees arising during attempted delivery or return.

• A $250 administrative handling fee, covering customs coordination, carrier communication, and restocking administration.

Any remaining refundable balance (if applicable) will only be processed once the artwork has been safely returned to us in its original condition.

5. Refunds & Returns

All sales are final once artworks have been shipped.

We do not offer refunds or exchanges for change of mind, nor for courier or customs delays.

If your artwork arrives damaged, please contact us within 48 hours of delivery with photos of the packaging and item. We’ll work with you to assess and, where possible, resolve the issue.

Refunds (where applicable) will be issued to the original payment method once approved.

6. Cancellations

6.1 Card Payments (Credit & Debit Cards)

Orders paid via card may be cancelled within 24 hours of purchase, provided the artwork has not yet been shipped or framed.

Because our payment provider does not refund processing fees, a 6% non-refundable transaction fee will apply.

The remaining 94% of your order total will be refunded to your original payment method.

6.2 Direct Deposit Payments

Orders paid via direct bank transfer may also be cancelled within 24 hours, provided the artwork has not yet been shipped or framed.

Due to currency conversion loss, bank charges and administrative handling, direct-deposit cancellations incur a 2% non-refundable processing fee.

The remaining 98% of your order total will be refunded to the same bank account used for payment once funds have fully cleared.

7. Errors, Inaccuracies & Omissions

Occasionally there may be information on our website that contains typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, or availability.

thefrmed. reserves the right to correct any errors, amend or update information, or cancel orders arising from such errors - including after an order has been submitted, if necessary.

8. Use of the Site

When using our site, you agree not to upload or transmit any viruses, malicious code, or engage in any unlawful, abusive, or disruptive behaviour. We reserve the right to suspend or terminate access if these Terms are violated.

9. Third-Party Links & Tools

Our Site may include links to third-party websites or tools (for example, payment processors, analytics, or shipping partners). We make no warranty about these external services and are not liable for any loss or damage arising from your use of them.

10. Intellectual Property

All images, text, and content on this website are owned by thefrmed. or the represented artists. You may not reproduce, distribute, or use any content without written permission.

11. Limitation of Liability

thefrmed. is not liable for indirect, incidental, or consequential damages resulting from the use of, or inability to use, this Site or its products. To the fullest extent permitted by law, our total liability is limited to the amount paid by you for the specific artwork in question.

12. Changes to These Terms

We may revise these Terms & Conditions at any time. The updated version will appear on the Site with the “Last updated” date. Continued use of the Site after any changes constitutes acceptance of the revised terms.

13. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes will be handled by the courts of Queensland.
